Terms of Service

By accessing or using feotherdisciplines.com and the FE Other Disciplines Simulator (collectively, "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and FE Tactical Press ("we", "us", "our").

The Service provides:

• A web-based exam simulator with 330+ practice problems for the FE Other Disciplines computer-based exam.
• Split-screen PDF handbook viewer for use with the NCEES FE Reference Handbook.
• Topic drills, full-length 110-question timed simulations, and a performance dashboard.
• Email progress reports during your access period.

The Service is an independent study tool and is not affiliated with, authorized, sponsored, or endorsed by NCEES. FE® and NCEES® are registered trademarks of the National Council of Examiners for Engineering and Surveying.

Registration: You must create an account with a valid email address and a password of at least 8 characters. You must be at least 16 years old to register.

Account security: You are responsible for maintaining the confidentiality of your credentials. You must not share your account with any other person. You must notify us immediately at legal@feotherdisciplines.com if you suspect unauthorized access.

One account per person: Creating multiple accounts to circumvent access restrictions or rate limits is prohibited and will result in termination of all associated accounts.

Access codes ("codes") are issued by FE Tactical Press and included with qualifying book purchases. Each code:

• Grants one (1) activation of 30-day full simulator access.
• May only be redeemed once.
• Is non-transferable and has no cash value.
• Must be redeemed by the purchaser; codes obtained by fraudulent means will be voided without refund.
• Expires 24 months from the date of book purchase if not redeemed.

One-time access ($29): grants 30 days of access from the date of purchase. Non-recurring.

Monthly subscription ($19/month): renews automatically on the same day each month until cancelled. You may cancel at any time via your account settings; cancellation takes effect at the end of the current billing period and no partial refunds are issued for unused days.

Payment processing: All payments are processed by Stripe, Inc. We do not store card details. By completing a purchase, you agree to Stripe's terms of service at stripe.com/legal.

Taxes: Prices are shown exclusive of VAT/GST where applicable. Applicable taxes will be calculated and displayed at checkout based on your billing country.

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial study purposes.

You may not:

• Copy, reproduce, distribute, or create derivative works from any questions, solutions, or content in the Service.
• Use automated tools (scrapers, bots, scripts) to access, extract, or download content from the Service.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Share your login credentials, sell access, or resell the Service in any form.
• Use the Service in any manner that could damage, disable, or impair our servers or networks.
• Publish, share, or transmit practice questions or solutions from the Service on third-party platforms (forums, social media, Discord servers, etc.).

All content in the Service — including but not limited to practice problems, solutions, software code, design, and trademarks — is owned by or licensed to FE Tactical Press and protected by copyright, trademark, and other applicable law.

The NCEES FE Reference Handbook is the property of NCEES. We do not distribute it. If you upload it to the split-screen viewer, it is stored locally in your browser and is not transmitted to our servers.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (a) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; (b) ANY SPECIFIC EXAM OUTCOME WILL RESULT FROM USE OF THE SERVICE; (c) THE CONTENT IS CURRENT WITH EVERY NCEES HANDBOOK UPDATE AT THE MOMENT OF YOUR ACCESS.

Exam preparation is inherently uncertain. Passing the FE exam depends on many factors beyond our control. We make no guarantee of passing the FE Other Disciplines exam.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FE TACTICAL PRESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, EXAM FAILURE, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

By you: You may delete your account at any time via account settings. Deletion is permanent and irreversible; no refund is issued for unused access days.

By us: We may suspend or terminate your account without notice if you violate these Terms, engage in fraudulent activity, or take actions that damage the Service or other users. In such cases no refund will be issued.

Upon termination, your license to use the Service immediately ends. Sections 6, 7, 8, 9, 11, and 12 survive termination.

These Terms are governed by the laws of Italy without regard to conflict-of-law principles. Any dispute that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of [your city], Italy.

If you are a consumer in the EU, you also have the right to use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We may update these Terms at any time. For material changes, we will provide at least 14 days' notice via email to registered users. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service before the effective date.
